These terms govern your use of OnDeck Academy (the “Service”) at ondeck-academy.com — the website, the free career tools, and the paid OOW Study Companion access. By using the Service or buying OOW Study Companion you agree to these terms. If you do not agree, do not use the Service.
OnDeck Academy is an independent education service built and operated by a working superyacht captain. It is not affiliated with, endorsed by, or acting on behalf of the Maritime and Coastguard Agency (MCA), the RYA, the PYA, or any flag state, certifying authority, or examination body.
1. Who we are
The Service is provided by OnDeck Academy. For any question about these terms, your account, or a purchase, contact us at ryansandwith9@gmail.com.
2. What the Service is — and is not
OnDeck Academy provides study material, practice tools, AI-assisted coaching, and career-record utilities to help superyacht crew prepare for their work and their examinations. It is a preparation and study aid.
It is not a certified or accredited course, it does not issue any qualification, certificate, endorsement, or sea-service verification recognised by the MCA or any other authority, and it is not a substitute for MCA-approved training, official nautical publications, a qualified instructor, or your own professional judgement. Nothing in the Service is navigational, legal, medical, financial, or tax advice. Regulations change: you are responsible for checking the current, in-force editions of any regulation, publication, or syllabus before you rely on it at sea or in an examination.
3. Accounts
Some features require an account, created by signing in with a magic link or a Google sign-in. You are responsible for keeping access to your email or Google account secure. You must give accurate information and are responsible for activity under your account. The career-record tools (logbook, certificates, endorsements, passport) store information you enter; you are responsible for its accuracy. Sea service you log is self-declared and is labelled as such — logging it in the Service does not make it verified, attested, or recognised by any authority.
4. OOW Study Companion, payment and the merchant of record
OOW Study Companion gives a signed-in account deeper OOW practice tools for twelve months from purchase, on any device you sign in on. It is a one-time purchase, not an auto-renewing subscription; access simply ends after twelve months unless you buy again. The price is shown at checkout in your local currency.
Payments are processed by Paddle.com Market Ltd (“Paddle”), our reseller and merchant of record. When you buy OOW Study Companion, your contract of sale for the payment is with Paddle, and Paddle’s Buyer Terms also apply. Paddle handles payment, invoicing, and applicable taxes (such as VAT). OnDeck Academy never sees or stores your card details.
Refunds are covered by our Refund Policy.
5. Access is for you
Access to OOW Study Companion is granted to a single account for the individual who bought it. Do not share your sign-in, resell access, or use automated means to extract the content or overload the Service. We apply fair-use limits to protect the Service from abuse; normal individual study is never affected. We may suspend or withdraw access if these terms are broken, refunding the unused portion where fair to do so.
6. AI-generated answers
The AI coach and tutor generate responses from study material and established sources, but they can be incomplete or wrong. Treat their output as study guidance to be checked, never as authoritative fact. Always verify any regulation, figure, or procedure against the current official source before relying on it in an examination or at sea.
7. Intellectual property
The Service, its content, tools, and design are owned by OnDeck Academy and protected by copyright. You may use them for your own study. You may not copy, republish, resell, or redistribute the content, in whole or in part, without written permission. Information you enter about yourself remains yours.
8. Availability and liability
We work to keep the Service available and accurate but provide it “as is”, without warranty that it will be uninterrupted, error-free, or fit for a particular purpose. To the fullest extent permitted by law, OnDeck Academy is not liable for any loss arising from use of, or reliance on, the Service — including examination outcomes, career decisions, or events at sea. Nothing in these terms limits liability that cannot lawfully be limited, and your statutory rights as a consumer are not affected. Where OnDeck Academy is found liable in connection with OOW Study Companion, that liability will not exceed the amount you paid for it.
9. Changes and governing law
We may update these terms; the “last updated” date above shows when. Material changes will be reflected on this page. These terms and any dispute relating to them are governed by the law of the jurisdiction in which OnDeck Academy operates, without affecting the mandatory consumer-protection rights of the country in which you live.
